Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to consider and pass orders on the petitioner's representation dated 06.11.2024 within a time frame fixed by this Court and further, to direct them to take all necessary steps to restore the revenue classification of the said land as Common Pathway in all official records grant such further or other orders as this Court deems fit.

Order This Writ Petition has been filed seeking for a direction to the second respondent to consider the petitioner's representation dated 06.11.2024 to restore the revenue classification of the property morefully described in the affidavit filed in support of this Writ Petition as a common pathway in all revenue records within a time frame to be fixed by this Court. 2/5

The learned Government Advocate for the respondents 1 to 4, on instructions, would now submit that the property morefully described in the affidavit filed in support of this Writ Petition cannot be classified as a common pathway, since the said property is a patta land owned by a private owner. Since no adverse orders are being passed against respondents 5 to 9, notice to them is dispensed with by this Court.
3. Since no final order has been passed based on the petitioner's representation dated 06.11.2024, this Court is of the view that no prejudice would be caused to the respondents, if final orders are passed by the second respondent based on the petitioner's representation dated 06.11.2024 within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the representation made by the petitioner.

For the foregoing reasons, this Court directs the respondent No.2 to pass final orders on merits and in accordance with law on the petitioner's representation dated 06.11.2024 seeking for restoration of the revenue classification of the property morefully described in the affidavit filed in support of this Writ Petition as a common pathway in all revenue records 3/5
after hearing objections of the respondents 5 to 9 within a period of twelve weeks from the date of receipt of a copy of this order.
