ORDER
The Power of Attorney representing the petitioner-company had filed the above writ petition for the following relief : "To issue a Writ of Mandamus to consider the representation made by the petitioner dated 17.10.2025 and direct the 3rd respondent to execute the lease deed in respect of a land measuring a precise area to an extent of 2.50.0 hectares in Government Poramboke land in S.F.No.603/1 (Part A) situated in Panchalakshipuram Village, Hosur Taluk, Krishnagiri to run Rough Stone Quarry for a period of 5 years."

The case of the petitioner is that the petitioner-company is the successful bidder in the tender cum auction conducted for quarrying the rough stone in the Government Poromboke land in S.F.No.603/1(Part A) situated in Panchalakshipuram Village, Hosur Taluk, Krishnagiri District. The mining plan submitted by the petitioner was approved by SEIAA, and it also issued the Environmental Clearance Certificate to the petitioner. Thereafter, the petitioner
had approached the Deputy Director, Geology and Mining, Krishnagiri, the 3rd respondent, for execution and registration of the lease deed with respect to rough stone quarrying. To his shock and surprise, on 13.12.2024, the petitioner received summons from the Sub Collector, Hosur, to appear for enquiry on 17.12.202. During enquiry, the petitioner was informed that they had illegally excavated and transported the stone blocks from the subject lands. According to the petitioner, the Sub Collector, Hosur and Tahsildar, Hosur had conducted enquiry and submitted their reports to the first respondent on 19.12.2024 and 30.07.2025 respectively, stating that "No unlawful excavation and transportation of stone block from the aforementioned lands was done by the petitioner or anyone else".

The grievance of the petitioner is that despite the reports of the Sub Collector and Tahsildar, Hosur, which would prove that the petitioner-company had not involved in any illegal quarrying, the detailed representation submitted by the petitioner to the 3rd respondent, requesting to execute the lease deed, was not considered to date. Hence, the petitioner is before this Court.
4. When the matter is taken up for hearing today, it is informed by Mr.Stalin Abhimanyu, learned Special Government Pleader appearing for the respondents 1 to 3, that the inspection has been conducted on 09.01.2026 by a Committee consisting of : (a) Sub Collector, Hosur; (b) Assistant Director
(Mines), Krishnagiri; (c) District Environmental Engineer (DEE), TNPCB, Hosur; (d) Taluk Surveyor, Hosur; and (e) Sub-Inspector of Survey (Mines), Krishnagiri.
5. In the light of the above, a mandamus is issued to the third respondent to consider and dispose of the petitioner's representation dated 17.10.2025 in line with Rule 8(6)(b) of the Tamil Nadu Minor Minerals Concession Rules, 1959, within a period of four weeks from today.
