O R D E R

The petitioner apprehends arrest at the hands of the respondent police for the offence under Section 303(2) of BNS Act, 2023 in Crime No.234 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2.The allegation against the petitioner is that she joined hands with 1/4

another lady stolen a gold chain weighing about 16.120 grams. Hence the case has been registered.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and she has not committed any offence as alleged by the defacto complainant and she has been falsely implicated in this case. He further submitted that she is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent Police reiterated the prosecution case and, upon instructions, submitted that totally there are two accused in this case and that the petitioner is ranked as A1. He further stated that co-accused/A2 in this case already arrested and released on bail by the learned Judicial Magistrate, Tiruchengode, vide order dated 24.11.2025 in C.M.P.No.411 of 2025. He further submitted that the property has been recovered and two previous cases of similar in nature have been registered against her. Hence, he opposed to grant anticipatory bail to the petitioner.

5.I have heard the learned counsel on either side and also perused the materials available on record.

6.Considering the aforesaid facts and circumstances of the case; and taking note of the submission made by the learned Government Advocate (Crl.Side); the nature of allegations; though property has been recovered and also considering the fact that she has also involved in two previous cases of similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed. 05.12.2025 ssi To:
