ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.10.2025 for the offences punishable under Sections 420 and 34 of IPC in Crime No. 69 of 2025, on the file of the respondent Police, seeks bail.
2. The allegation against the petitioner is that the petitioner collected a sum of Rs.23,46,000/- from the de-facto complainant to invest in IFS Company and the said amount was swindled and misappropriated the amount by the petitioner herein. Hence the complaint and the petitioner was arrested on 15.10.2025.
3. The learned Counsel for the petitioner submits that already before the EOW, Chennai, a separate complaint was registered against the IFS Company to the tune of several crores of rupees and the petitioner is also a victim of the same. The petitioner is not an accused in this case and he was arrested and remanded to judicial custody from 15.10.2025. He further submits that the petitioner is ready to abide by any conditions imposed by this Court. He prays bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submits that the petitioner collected a sum of Rs.23,46,000/- to invest in IFS Company and the said amount was transferred by the petitioner herein, and immediately, by using the amount, he
purchased lands to the extent of 2.34 acres in the name of his wife, who was ranked as A2 in this case and subsequently, it was also once again transferred in the name of his father-in-law, thereby, the money has been swindled by the petitioner herein. Hence, he opposed for grant of bail to the petitioner.

Considering the fact that though it is stated that the petitioner is also one of the victim of the IFS Company and he has also involved in the offence and the statement made by the learned Government Advocate, revealed that the money was collected by the petitioner herein, by using the said amount, he purchased lands and also money was siphoned off by the petitioner herein. It is a clear case of cheating the de-facto complainant by the petitioner herein, hence, I am not inclined to grant bail to the petitioner.
