ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.09.2025 for the alleged offence under Sections 8(c), 20(b)(ii)© & 29(1) of Narcotic Drugs and Pscychotropic Substances Act 1985 in Crime No.475 of 2025 on the file of the respondent police, seeks bail.
2. This Court has dismissed the first bail petition of the petitioner in Crl.O.P.No.29734 of 2025 on 17.11.2025 for the following reasons:
6. Considering the fact that the quantity seized is 20.434 kgs of ganja, which is a commercial quantity, Section 37 of the NDPS Act is applicable. However, though no recovery was made from the petitioner, the statements recovered from the arrested accused reveals that he actively participated in the transportation of the commercial quantity. Hence, Section37 of the NDPS Act is applicable to the case of the petitioner. Since the investigation is pending, this Court is not inclined to grant bail to the petitioner.

In view of the above facts and this is the second bail application and the earlier bail application in Crl.O.P.No.29734 of 2025 was dismissed by this Court on 17.11.2025 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. This Criminal Original Petition stands dismissed .
