Criminal Miscellaneous Petition filed under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, to suspend the order of sentence and conviction passed in Spl.S.C.No.183 of 2023 dated 08.01.2025 by the Fast Track Court exclusively to deal with offences under the POCSO Act, Puducherry and enlarge the petitioner on bail pending disposal of the criminal appeal.

O R D E R

This criminal miscellaneous petition has been filed seeking to suspend the sentence imposed by the learned Sessions Judge, Fast Track Court Exclusively to deal with offences under the POCSO Act, Puducherry, in Spl.S.C.No.183 of 2023, vide judgment dated 08.01.2025, in and by which, the trial Court had convicted the petitioner for the offence under Section 23(4) of the POCSO Act and directed the petitioner to pay a fine amount of Rs.20,00/- and in default to undergo simple imprisonment for a period of three months.

2. When the matter was taken up for hearing, the learned counsel for the petitioner/accused submitted that the petitioner had paid the entire fine amount as ordered by the trial court, as early as on 08.01.2025 and hence, he sought permission of this Court to withdraw this petition. An endorsement to the said effect was also made by the learned counsel for the petitioner in the petition today.

3. In view of the above, this criminal miscellaneous petition stands dismissed as withdrawn.

4. Registry is directed to call for the records from the trial court, if not already received, prepare the paper book/typed set of papers and post the main appeal for hearing in the usual course. 13.03.2026 skt To 1.
