O R D E R

Writ Petition is filed for issuance of a Writ of Certiorarified Mandamus calling for the records with regard to continued suspension vide Rc. No. 53252/ PR IV (2)/2025 in CPO. No. 2778/2025 by order dated 21.08.2025 passed by the 1st respondent and quash the same and consequently directing the respondents to reinstate the petitioner into the service with all consequential benefits thereon.

2.Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the first respondent. 3.Since no adverse order is being passed against the respondent 2, notice to him is dispensed with.

4.The case of the petitioner is that he was recruited to the post of Grade II Constable in the year 2012 and posted at III-Battalion at Veerapuram, Avadi and in the year 2021, he was transferred to Armed Reserve Police in the year 2021. Thereafter, he was transferred to F1 Police Station, Chindatripet, where 2/6

he got promoted as Grade-I Constable on 01.02.2021. On 05.07.2023, he was directed to be deputed as Sepoy in Narcotics Central Bureau, Chennai for a period of three years and in pursuance of the same, he was relived and joined the Narcotics Central Bureau Chennai Zonal Unit on 30.06.2023. While he was working as Sepoy in the Narcotics Central Bureau, Chennai his name was falsely implicated in Crime No. 266 of 2024 on the file of the KK Nagar Police Station for the offences under Section 294(b), 324, 452, 384 and 506(i) of IPC and the Crime No. 490 of 2024 on the file of the MGR Nagar Police Station for the offences under Section 294(b), 323, 384 and 506(i) of IPC based on the confession statement made by the co-accused.

Therefore, the petitioner had prayed for anticipatory bail and he was enlarged on anticipatory bail by separate orders dated 24.03.2025 in Criminal O.P. Nos. 6291 and 6528 of 2025. However, merely because of the fact that a criminal case has been lodged against the petitioner, he was placed under suspension on 21.08.2025. Thereafter, the petitioner has made representation dated 25.08.2025 to the 1st respondent to revoke the order of suspension. However, till date, the 1st respondent has not considered the same. Hence, the present writ petition. 5.The learned counsel for the petitioner submitted that though the order of suspension has been passed on 25.08.2025, there has been no review. The prolonged suspension cannot be allowed to continue for a long time.

drawn attention of this Court to the judgment of the Hon'ble Apex Court in Ajay Kumar Choundhary Vs. Union of India reported in (2015) 7 SCC 291, wherein it has been held that suspension must necessarily be for a short duration. He further submitted that till date charge memo was not issued and enquiry was not conducted. However, it would suffice, if this Court permits the petitioner to make a fresh representation within a period of two weeks from the date of receipt of a copy of this order and issue a direction to the 1st respondent to consider the fresh representation and pass orders thereafter. 6.

Considering the limited request made by the petitioner, this Court hereby directs the 1st respondent to consider the representation to be submitted by the petitioner within a period of two weeks from the date of receipt of a copy of this order and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of such representation. 7.The writ petition is disposed of on the above terms. No costs. Consequently, the connected miscellaneous petition is closed. 16.12.
