ORDER
(Order of the Court was made by C.V.Karthikeyan J.) This petition has been filed seeking to condone the delay of 281 in filing the above appeal.
2. In the affidavit filed explaining the delay, it had been stated that owing to administrative reasons, sanction had to be obtained to file the appeal and in that process, there has been a delay. As a matter of fact, even earlier on 08.01.2025, this Court had already permitted Respondents 26, 27 and other respondents to withdraw 25% of their claim.
3. Taking all factors into consideration, this petition is allowed and the delay in filing the appeal is condoned.
4. There is already an order on 08.01.2026 in C.M.P.No.30561 of 2025 permitting Respondents 26, 27 and other respondents to withdraw 25% of their share from and out of the amount already deposited by the appellant. However, learned counsel for Respondents 26,27 and 32 submits that there is some difficulty in getting permission from the trial Court to withdraw the amount. A direction is issued to the trial Court / I Additional Subordinate Court, Coimbatore to permit Respondents 26, 27 and 32 to withdraw 25% from and out of the amount already deposited by the appellant herein without any delay. Registry is directed to number the appeal, if it is otherwise in order and post the same for admission on 21.06.2026.
