Prayer in W.P. No.48467 of 2025 : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the respondents to disburse the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01.01.2024 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement within a time limit. For petitioners : Mr.J. Lakshminarayanan For respondents : Ms. S. Pavithra COMMON ORDER Ms.S. Pavithra, learned Standing Counsel takes notice for respondents. With the consent of both the parties, the writ petition is taken up for final disposal today at the stage of admission itself.
2. The petitioners worked as Selection Grade and Special Grade Conductors in the 1st respondent Transport Corporation and retired from service on 31.03.2024 respectively. It is their case that the Dearness Allowance payable to Transport Corporation employees stood at 46% of the basic pay as on 01.07.2023. Subsequently, with effect from 01.01.2024, the Dearness Allowance was revised to 50% of the basic pay. However, while calculating the petitioners' retirement benefits, the said revision of Dearness Allowance by 4% was not taken into account, resulting in short payment of retirement benefits. Therefore, respective petitioners submitted individual representations on 15.09.2025 and 2/5
20.09.2025, seeking disbursement of the differential amount arising out of the revised Dearness Allowance, along with interest at the rate of 8% per annum for the belated payment. However, till date, no orders have been passed on the said representation.

Learned counsel for the petitioners submitted that it would suffice, if a direction is issued by this Court to consider the petitioner's representations, as referred to supra as well as sought a direction to the respondents to disburse the eligible differential amount with interest, within a stipulated period.
4. Learned Standing Counsel appearing for the respondents submitted that petitioners' representations will be considered by the 1st respondent and orders will be passed in accordance with law.

In view of the limited prayer made by the learned counsel for the petitioners, this Court directs the 1st respondent to consider the petitioners' representations dated 15.09.2025 and 20.09.2025 respectively, on merits and in accordance with law and, if they are entitled, to disburse the differential amount arising out of the revision of Dearness Allowance, together with interest at the rate of 6% per annum, within a period of four weeks from the date of receipt of a copy of this order.
