This appeal has been directed against the order passed by the Writ Court dated 19.11.2025 made in W.P.No.28915 of 2024.

There has been a notification in Notification No.3 of 2018 issued by the Tamil Nadu Public Service Commission (TNPSC) on 14.02.2018 to fill up the posts of Motor Vehicle Inspector Grade I and at that time the notified vacancies were 113. Though the selection process went on, for the reason that some of the candidates / selectees have not been trained in recognised institutions / workshops, appointments were not made. Challenging the same, number of writ petitions were filed before this Court and the matter went upto the Hon'ble Supreme Court and the matter is still pending in S.L.P.(C) No.7906 of 2025.

3. While that being so, the TNPSC has come forward to issue another notification in Notification No.11 of 2024 dated 13.08.2024 for filling up the current vacancies which is quantified as 45 for the post of Motor Vehicle Inspector Grade II and this process is going on.

The apprehension of the writ petitioner / appellant along with the third respondent, who stood as another writ petitioner before the Writ Court is that, once the results are published pursuant to the 2024 notification, selection is completed and selectees are permitted to join duty as Motor Vehicle Inspectors, if the petitioners ultimately succeed before the Hon'ble Supreme Court in the pending SLP, even if they get appointed, their seniority will be in the doldrum. Therefore, in order to rectify the same or to get a clarification to that effect, they want to stall the present selection process pursuant to Notification No.11 of 2024 issued by the TNPSC. With that intention, the petitioner has filed the present writ petition.

The learned Writ Court, having considered this factual matrix, has come to the conclusion that, insofar as the 2018 Notification is concerned, the vacancies identified were 113 and excluding those 113 vacancies only the current vacancies ie., 45 vacancies since has been notified for which the second notification is issued, even if selection is made under the 2024 notification, that would not prejudice the interest of the selectees pursuant to the 2018 notification, of course, after the orders one way or the other passed by the Hon'ble Supreme Court in the pending Special Leave Petition and therefore on that ground the learned Writ Court rejected the present plea raised by the appellant through the impugned order.

6. We have heard Mr.T.Gowthaman, learned Senior Counsel for the appellant, Mr.P.Kumaresan, learned Additional Advocate General for the first respondent, Mr.B.Vijay, learned Standing Counsel for the second respondent and Ms.K.S.Ritika, learned counsel for the third respondent.

After having gone through the impugned order, we are in complete agreement with the view taken by the learned Single Judge who passed the impugned order by taking into account the factual matrix that the 113 vacancies pertaining to 2018 notification are untouched, as that would depend upon the result of the Special Leave Petition pending before the Hon'ble Supreme Court. Therefore, merely because the SLP is pending, subsequent notification and the selection process which is already underway, need not be stalled. The said view taken by the learned Writ Court is accepted by us and the present appeal since has to be rejected, we are inclined to reject this writ appeal. Accordingly, the writ appeal is dismissed.
