ORDER

The petitioner had purchased a property ad measuring 13 cents in S.No.420/2B1 under sale deed dated 23.06.2023. In relation thereto, order dated 25.04.2025 was issued directing the petitioner to pay additional stamp duty and registration fee of Rs.2,23,132/-. Assailing the said order, the petitioner filed an appeal on 25.11.2025. On the ground that the document cannot be retained for such a long period, the petitioner seeks a direction for a return thereof.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. By relying on the judgment of the Division Bench of this Court in the Special Deputy Collector (Stamps), Palayamkottai v. M.Alfred, 2017(2) CWC 896, particularly paragraph 32 thereof, he submits that the petitioner is not entitled to a release of the document pending adjudication of the appeal.

In paragraph 32 of the judgment cited above, the Division Bench of this Court held that the petitioner may seek the conclusion of proceedings on expedited basis, but cannot seek release of the instrument in question pending adjudication. In view of the pendency of the appeal, at this juncture, the petitioner is not entitled to release of the document. It is, however, open to the petitioner to apply for the early disposal of such appeal.

4. With the above observations, the writ petition is disposed of. There will be no order as to costs.
