Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the 1st respondent / the District Collector, Coimbatore, to dispose of the petitioner's pending appeal No.1873776/2024/U2 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

O R D E R

This writ petition is filed for the following relief: "To direct the 1st respondent / the District Collector, Coimbatore, to dispose of the petitioner's pending appeal No.1873776/2024/U2 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007".

2. The petitioner is a senior citizen aged about 75 years. He would submit that the 2nd respondent is his son.

3. It is the case of the petitioner that after settling his property in favour of the 2nd respondent, the 2nd respondent started treating him badly. Further, the 2nd respondent is not maintaining the petitioner. Therefore, the petitioner approached the Maintenance and Welfare of Parents and Senior Citizens Tribunal, to restore back the properties to 2/6

his name. The petitioner would submit that the said petition was dismissed.

4. Challenging the same, he has filed an appeal under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, before the 1st respondent, the District Collector, Coimbatore District, and the 1st respondent ordered interim maintenance by his order dated 26.07.2024.

5. The petitioner would submit that since there is no progress in the said appeal, he has made a representation to the 1st respondent seeking early disposal of the appeal. Aggrieved by the inaction on the side of the 1st respondent the petitioner is before this Court.

6. Heard the learned counsels and perused the records.

7. The petitioner has preferred an appeal as early as on 04.03.2024 and he has got interim orders of maintenance on 26.07.2024. However, there is no progress in the appeal thereafter. In 3/6

view of the above facts, the 1st respondent is directed to dispose of the appeal filed by the petitioner within a period of 1 month from the date of receipt of a copy of this order.

8. With the above direction, this writ petition is disposed of. No costs.
