The petitioner, who was arrested and remanded to judicial custody on 30.10.2025, for the offences punishable under Section 123 of BNS Act in Crime No.629 of 2025, registered on the file of the respondent police, seeks bail.

2.The allegation against the petitioner is that this petitioner induced the defacto complainant to purchase tablet for the purpose of intoxication and accordingly, he mixed it in glucose water, forced him to consume it, and after collecting money, which resulted in causing severe health issues to the defacto complainant. Hence he has lodged the complaint. Based on the complaint, the police have also arrested the accused and recovered 30 numbers of aspadol tablets.

3.The learned counsel for the petitioner submitted that the name of the tablet was not mentioned in the FIR and the petitioner is in custody from 30.10.2025 and the contraband not falls within the schedule of NDPS Act. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reported that this is a new tablet being introduced for intoxication by the petitioner and totally 30 numbers of tablets have been recovered and cash to the extent of 10,000/- was also recovered from the petitioner herein and the investigation is pending. Apart from that, the petitioner is having 3 previous cases out of which one case is under the NDPS Act. Hence, he opposed for grant of bail to the petitioner. 2/4

5.I have considered the submissions made on learned counsel on either side and perused the records, which revealed that the petitioner is used tablet named aspadol and for the purpose of intoxication and sold it to the defacto complainant and it is also developed serious health issues to him. Considering the above facts, and also the fact that the petitioner is having previous cases, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 03.12.2025 mpa To 1.The Inspector of Police, Nallur Police Station, Tiruppur City.
