Prayer in Crl.O.P.No.340 of 2026 : Criminal Original Petition filed under Section 528 of BNSS, 2023 to call for the records pertaining to the FIR registered in Crime No.301 of 2025 on the file of the 1st respondent and quash the same.
In both Crl.O.Ps.:

Side), for R1 COMMON ORDER These criminal original petitions have been filed seeking quashment of the First Information Reports in Crime Nos.372 & 301 of 2025 respectively, both pending investigation on the file of the 1st respondent.

Based on the false and exaggerated complaints given by the respective 2nd respondent/de facto complainants, who are none other than the close relatives of the petitioners, alleging that the petitioners have illegally occupied their house site and when the same was questioned by them, the petitioners abused them using filthy language, attacked them using wooden logs and crowbar and also threatened them with dire consequences, an FIR in Crime No.372 of 2025 came to be registered on the file of the 1st 2/7
respondent as against the petitioners in Crl.OP.No.338 of 2026 for the offences under Sections 115, 118(1), and 351(3) of BNS, 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 and another FIR in Crime No.301 of 2025 came to be registered on the file of the very same respondent police as against the petitioners in Crl.OP.No.340 of 2026 for the offences under Sections 296(b), 115(2), and 351(3) of BNS, 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002. Challenging the same, these petitions have been filed.

Learned counsel for the petitioners submitted that it is a case of case and counter case and the petitioners and the de-facto complainants are close relatives and due to certain civil disputes pending between them, the present false complaints came to be registered as against the respective petitioners. He further submitted that insofar as the 3rd petitioner in Crl.OP.No.338 of 2026 is concerned, she is the daughter of the 1st and 2nd petitioners and she is permanently residing in Kanchipuram with her husband and at the time of alleged occurrence, she was not at all present, since she was writing her B.E. semester examinations at Kings Engineering College, Sriperumbudur, Chennai, which is away from the scene of 3/7
occurrence. Further, insofar as the 3rd and 4th petitioners in Crl.OP.No.340 of 2026 are concerned, they are the son and son-in-law of the 1st and 2nd petitioners and they were also not present at the scene of occurrence and only in order to harass them and to spoil their career prospects, they have been falsely implicated in this case. He also submitted that the de facto complainants herein, along with others, trespassed into the land owned by the 1st petitioner and threatened them with dire consequences and aggrieved by the same, the 2nd petitioner lodged a complaint, pursuant to which, though an FIR in Crime No.201 of 2025 came to be registered, no further action has been taken till date.
Further, due to the harassment and threatening of the de facto complainants, the 2nd petitioner consumed poison and got admitted to the hospital, pursuant to which, the 3rd petitioner in Crl.OP.No.340 of 2026, son of the 1st and 2nd petitioners, made a complaint before the very same respondent police. However, till date, no action has been taken on the said complaints, which itself shows the biased enquiry conducted by the 1st respondent police. Accordingly, he prayed for quashment of the impugned FIRs.

4. Per contra, the learned Government Advocate (Crl. Side) appearing for the 1st respondent police submitted that though it is the claim of the petitioners that due to some civil dispute between the family members, the present complaints have been lodged, it is pertinent to note that the 2nd respondent/de facto complainant was treated as outpatient and whether some of the persons arrayed as accused were present at the scene of occurrence is a matter for investigation and only after due investigation, the same can be found out. He further submitted that the respondent-police will conduct a proper investigation and if it is found that any of the petitioners herein, particularly the 3rd petitioner in Crl.OP.No.338 of 2026 and the 3rd and 4th petitioners in Crl.OP.No.340 of 2026 are not at the scene of occurrence, necessary steps will be taken to remove their name from the respective FIRs.
5. Though very many grounds have been raised by the learned counsel on either side, at the time of arguments, in view of the submission made by the learned Government Advocate (Crl. Side), this Court, without going into the merits of the case and without interfering with the impugned FIRs, directs the 1st respondent police to conduct a fair and proper investigation in both the cases in Crime Nos.372 & 301 of 2025 respectively and file final 5/7
reports within a period of two (2) months from the date of receipt of a copy of this order, only against those who have committed the offences stated in the respective FIRs.
6. With the above directions and observation, these criminal original petitions stand disposed of.
