..Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider
the petitioner's representation dated 28/10/2025 and pay me the enhanced compensation by fixing the value of the land at Rs.15,000/ - per cent with all other benefits as per the Land Acquisition Act with interest on solatium and with all other benefits in the light of the decree and judgment passed by the Honourable Division Bench, Madras High Court in A.S.No.1003 of 2015, dated 19/08/2021, the respondents are hereby requested to pay the difference amount of Rs.9,250/- which I am also entitled to receive. ORDER
The petitioner's land was acquired and compensation in relation thereto was fixed. In protest, the petitioner received the compensation. Being dissatisfied with the quantum of compensation, the petitioner had sought for enhanced compensation and such enhanced compensation was also directed to
be paid. After coming to know that adjacent land had been acquired on payment of higher compensation, the petitioner submitted a representation seeking parity. The present writ petition relates thereto.
2. Mr.Vadivelu Deenadayalan, learned Additional Government Pleader, accepts notice for respondents 1 & 3. Mr.K.Sudalai Selvan, learned standing counsel, accepts notice for the second respondent.
3. Learned Additional Government Pleader submits that the request for fixing the compensation at Rs.15,000/- per cent and for the payment of other benefits on such basis should not be granted. He, however, submits that the representation would be considered in light of the judgment and decree in A.S.No.1003 of 2015.
4. The petitioner has submitted a representation dated 28.10.2025 by relying on the judgment of this Court in A.S.No.1003 of 2015, dated 19.08.2021. Therefore, it is just and necessary that such representation be
considered and disposed of on merits. While considering the said representation, the applicability of the judgment and decree in A.S.No.1003 of 2015 to the petitioner should also be examined. Subject to these observations, the writ petition is disposed of by directing the first respondent to pass orders on the petitioner's representation dated 28.10.2025 within one month from the date of receipt of a copy of this order.
