ORDER

By consent of both parties, this writ petition has been taken up for final

disposal at the admission stage itself.

2. The petitioner seeks for a direction to consider the representation to remove his wife/fifth respondent name in the ration card. The petitioner has already filed a divorce petition in OP.No.40/2024 on the file of Sub Judge, Attur. It is the grievance of the petitioner that while the matter stood thus, his wife name has been wrongly included in the ration card, hence, seeks for a direction.

3. Heard both sides and perused the materials placed on record. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.

4. At the outset, this Court is of the view that the very writ petition is not maintainable and is nothing but of abuse of process of law. Admittedly, now, the status of the parties remain as husband and wife, the marriage is not dissolved. Therefore, merely because the wife name is included in the ration card, it cannot be said that the same should be removed at this stage. As long as the marriage is not dissolved by a decree of divorce, the petitioner cannot seek to remove the name of her wife in the ration card.

5. Accordingly, this Court does not find any merits in this petition and this

petition stands dismissed. No costs. Consequently, connected miscellaneous petition stands closed.
