ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 1 st respondent to consider and pass orders on the representation made by the petitioner dated 24.03.2025.

2. By consent of the parties, this Writ Petition is taken up for disposal at the admission stage itself. Since no adverse order is going to be passed, notice to the 4 th respondent is dispensed with.

The learned counsel appearing for the petitioner would submit that the petitioner married one Kalimuthu / 4 th respondent, who is serving as Village Administrative Officer and he deserted the petitioner and her family without spending anything. Thereafter, the petitioner filed a restitution of conjugal right petition in HMOP.No.183 of 2018, which was later re-numbered as HMOP.No.431 of 2020 on the file of the Family Court, Tirupur and the same was ordered vide order dated 25.05.2024. Subsequently, she also filed a maintenance case in MC.No.16 of 2020 on the file of the Family Court, Tiruppur and the same was allowed after contested, by issuing direction to the th respondent to pay a sum of Rs.30,000/- per month to the petitioner. Since the same was not paid, the petitioner filed a petition in Crl.M.P.Nos.

20 & 19 of 2025 for payment of arrears of maintenance amount however, the same was also ordered by the Family Court by order dated 10.09.2025 & 06.10.2025 by attaching the 4 th respondent's salary. He would further submit that despite an order for attachment, the respondents 1 & 2 have not taken any steps to recover the amount from his salary. It is stated that the 4 th respondent is going to be retired on 31.12.

respondent, the petitioner and her family would suffer loss without any payment which was ordered by the Family Court thereby, the present writ petition is filed for appropriate orders.

The learned counsel appearing for the petitioner would submit that this Court may issue a direction to the 2 nd respondent to conduct enquiry in between the petitioner and the 4 th respondent and give effect to the attachment order passed by the Family Court by passing appropriate orders strictly in terms of the service rules.

5. The learned Special Government Pleader appearing for the respondents would submit that the enquiry will be conducted in between the petitioner and the 4 th respondent and appropriate orders will be passed within the specified time.

6. Considering the limited request made by the petitioner and the fact that

the 4 th respondent's salary was attached by the Family Court in Crl.M.P.Nos. 20 & 19 of 2025 dated 10.09.2025 & 06.10.2025, there shall be a direction to the nd respondent to conduct enquiry in between the petitioner and the 4 th respondent and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. Till such time, the respondent concerned shall not disburse the salary benefits to the 4 th respondent.
