One Lakh per month to the credit of the suit in O.S.No. 482 of 2022 and Clause (iv) to include the suit in O.S.No.137 of 2024 along with the suit in O.S.No. 482 of 2022.

ORDER

This petition has been filed seeking modification of the order dated 06.11.2025, particularly Clause 12 (iii) and 12 (iv).

2. It is stated in the affidavit filed in support of this petition that the petitioner's earlier undertaking to deposit a sum of Rs.1,00,000/- per month was given by the petitioner's son without proper instructions and the petitioner is not in a financial position to comply with the same. It is further 2/3

stated that as per the directions issued earlier by this Court, the petitioner has now taken a Demand Draft bearing No.504059 dated 12.03.2026 for a sum of Rs.4,00,000/- drawn on ICICI Bank towards arrears of rent and undertakes to deposit the same before the Trial Court viz., III Additional District Judge, Gobichettipalayam, within a short time.

3. Heard the submissions made by the learned counsel on either side.

4. Learned counsel appearing for the private respondents has no objection for allowing this petition.

5. Recording the aforesaid undertaking given by the petitioner, this Court directs the petitioner to deposit the Demand Draft for a sum of Rs.4,00,000/- to the credit of O.S. No.482 of 2022 on the file of the III Additional District Judge, Gobichettipalayam, within a period of two weeks from today.

6. Having regard to the reasons stated in the affidavit filed in 3/3

support of this petition and considering the submissions made by learned counsel on either side, this Court is inclined to modify the earlier order.

7. Accordingly, Clause 12(iii) and (iv) of the order dated 06.11.2025 shall stand modified as under is modified to the effect that the petitioner shall deposit a sum of Rs.20,000/- (Rupees Twenty Thousand only) per month instead of Rs.1,00,000/- per month, to the credit of the suit in O.S.No.482 of 2022.

8. Further, Clause 12(iv) is modified by including O.S.No.137 of 2024 along with O.S.No.482 of 2022.

9. Except the above modifications, all other conditions in the order dated 06.11.2025 shall remain unaltered.

The matter is today listed under the caption 'for being mentioned'.

2.The learned counsel appearing for the petitioner submitted that since the petitioner's financial position was weak, the petitioner filed this miscellaneous petition and sought for modification in the amount directed to be deposited towards monthly rent, however, the petitioner is now ready to deposit a sum of Rs.1 Lakh per month to the credit of O.S.No.482 of 2022 and prayed for appropriate orders. 3.The learned counsel appearing for the private respondents raise no serious objection.

4.In view of the above, Paragraph no.7 of the order dated 13.03.2026 made in W.M.P.No.55766 of 2025 in W.P.No.26536 of 2025, is to be read as follows:

"7.Accordingly, Clause 12(iii) of the 7/3

order dated 06.11.2025 needs no modification and the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh Only) per month to the credit of O.S.No.482 of 2022."

5.Registry is directed to carry out the necessary corrections and re-issue copy of the order to the respective learned counsel appearing for the parties.
