ORDER

This Writ Petition has been filed seeking a direction to the respondents to grant Modified Assured Career progression (MACP) benefits to the petitioner upon completion of 30 years of service and pay the arrears with interest and refix the pension, by considering the petitioner's representation dated 04.01.2024, 08.09.2025 and 14.10.2025.

2. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that he served as a Post Graduate Teacher (Mathematics) in the first respondent School for more than 34 years. The grievance of the petitioner is that though he retired on 31.05.2025, he was not extended with the benefit of the 3rd Modified Assured Career Progression (MACP), on completion of 30 years of service, as per the guidelines issued

under the VI and VII Pay Commissions. In this regard, the petitioner made several representations, the latest being dated 14.10.2025, seeking to extend the benefits of the 3rd MACP and grant all consequential monetary and service benefits. However, the none of said representations has been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the second respondent to consider the representation of the petitioner dated 14.10.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondent.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the second respondent to consider the petitioner's representation dated 14.10.2025 on merits and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
