..Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records on the files of the 5th respondent herein relating to his refusal Number: RFL/Kelamangalam Book 2/1/2021, dated 13.08.2021, quash the same and

consequently, direct the 5th respondent herein to register the Partition deed dated 09.07.2021, presented by the petitioner along with his family. For Petitioner:

ORDER

The petitioner presented partition deed dated 09.07.2021 for registration. Such request was rejected under impugned refusal check slip dated 13.08.2021.

2. By referring to the impugned refusal check slip, learned counsel for the petitioner submits that it is recorded therein that S.No.671 is classified as poramboke. By inviting my attention to the patta obtained by the petitioner, learned counsel submits that patta no.832, which covers S.Nos.671 and 724/1, was issued in the name of the petitioner. He also refers to the A-register in this regard.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. He submits that the Sub-Registrar would verify the authenticity of patta no.832, the A-register and the communication dated 29.09.2021 from the Tahsildhar to the Sub-Registrar and thereafter, take a decision.

4. On examining patta no.832 and the A-register in respect of S.No.671, it appears prima facie that the land is classified as ryotwari punjai and that the pattadhar is Veerabadrappa. Therefore, impugned refusal check slip cannot be sustained and is set aside. As a corollary, the Sub-Registrar, Kelamangalam, is directed to reconsider the matter and take necessary measures in relation to registration within one month from the date of re-presentation of the partition deed.

5. With the above observations, the writ petition stands disposed of without any order as to costs.
