The petitioner, who was arrested and remanded to judicial custody on 07.08.2025, for the offences punishable under Sections 109 of BNS Act, 2023 and subsequently, altered to section 103(1), 61(2) of BNS, 2023 in Crime No. 35 of 2025 registered on the file of respondent police, seeks bail. 2.The case of the prosecution is that there was a property dispute between the petitioner-A4 and family members of the deceased, which enraged A1; that thereby A1 conspired with other co-accused and murdered the deceased using deadly weapons. Further, it is alleged that the petitioner herein assisted in other co-accused who were involved in the commission of offence. Hence the case.
3.The learned Counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has not aware about the intention of the other co-accused involved in the alleged offence. He further submits that the petitioner was arrested and remanded to judicial custody from 2/8
07.08.2025. He further submits that the co-accused were arrested and released on bail by order of this Court dated 20.11.2025 in Crl.O.P.No.31743 of 2025 and in Crl.O.P.No. 27742 of 2025, dated 10.10.2025. He further submits that the petitioner is ready to abide any condition imposed by this Court and therefore, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate [Criminal Side] appearing for the respondent police while opposing the bail to the petitioner, reiterated the prosecution case and submits that totally four accused had involved in this case. He further submits that the petitioner is ranked as A3. He further submits that investigation is completed and final report has also been filed and S.C.Number is not yet assigned. He further submits that the co-accused were granted bail.

5. Earlier this Court dismissed the bail applications on the ground that the investigation is not concluded and the petitioner is having specific overtact. Now, it is reported that the investigation is concluded and final report has also been filed, committed to sessions Court, and S.C. number is not yet assigned by the trial Court.
6.Considering the fact that the co-accused in this case were already arrested and released on bail in Crl.O.P.Nos.27742 of 2025, dated 10.10.2025 and 31743 of 2025, dated 20.11.2025 and also similarly placed with the petitioner herein and the period of incarceration of the petitioner from 07.08.2025 and there is change in circumstances; I am inclined to grant bail to the petitioner with certain conditions. 7.Accordingly, the petitioner is ordered to be released on bail on his 4/8
executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate, Sholingar and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] that the petitioner shall appear before the Trial Court daily at 10.30 am for a period of three weeks and thereafter as and when required for intention. [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the 3 rd petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 5/8
SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
