ORDER

The writ petition has been filed seeking a direction to the first respondent to instruct the second respondent to take appropriate action against the fifth respondent for allegedly obtaining a forged legal heirship certificate in respect of a deceased person, based on the certificate issued by fourth respondent dated 20.03.2025.

2. According to the petitioner, the fifth respondent, stated to be the son born through the second wife of the Periyasamy Gounder(petitioner's grand father), has obtained a legal heirship certificate several years after the death of the petitioner's mother on 07.12.2003. It is alleged that the fifth respondent had secured the certificate in 2006 without including the petitioner and her two sisters. Hence, the petitioner seeks action against the fifth respondent.

3. Heard both sides and perused the materials placed on record.

4. This Court is of the view that the legal heirship certificate issued by the Tahsildhar is only a relationship certificate and does not finally determine the legal status of the parties. Whether the petitioner or the fifth respondent is the lawful heir to the ancestor must be established before the competent Civil Court through proper evidence, and not on the basis of the certificate issued by the revenue authorities.

5. Hence, the parties are directed to establish their respective status before the concerned Civil Court.

6. With the above observations and directions, this writ petition is disposed of. No costs.
