This Miscellaneous Petition is filed to recall the order dated 20.11.2025 whereby the right to file counter affidavit stands forfeited. 1/6

2. The learned counsel appearing on behalf of the second respondent submitted that the counter affidavit is ready and that he will be filing the same into the Registry and thus, this Court may recall the order and grant permission to do so.

3. The learned counsel for the petitioner has not seriously opposed the reasons indicated in the affidavit filed in support of the Miscellaneous Petition.

4. In view of the aforesaid submission, the time for filing counter affidavit by the second respondent is extended till 08.12.2025 subject to the payment of costs of Rs.5,000/- to the Madras High Court Legal Services Committee.

5. Registry is directed not to accept the counter affidavit in the matter without proof of payment of costs.

6. This Miscellaneous Petition is ordered accordingly. 2/6
