Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records from the 2nd respondent relating to the issue of Online Tender Notice issued in Tender No.ME -29-II -1075- 2025 Run Date/time. 20.11.2025 /17.00 hrs and from the 1st respondent relating to his Lr. No.M/GS/2025- 26/ABS/ GDY / Electrical Works dated 21.11.2025 and quash the same and further to direct the respondents (i) to measure the works completed fully under the non- scheduled items of Electrical works under item Nos. 1,2,3,4,7,8 and 13 and pay for the same with 18 percent from Feb 2025 to the date of payment.

(ii) to direct the respondents to show the location at which the purchased materials to be fixed at site and to pay for the same with 18 percent interest to the petitioner from Feb 2025 to till the date of payment. (iii) to pay to the petitioner the balance amount for the completed works under the main contract which has not been paid without any reason from Feb 2025 to the date of payment and (iv) to direct the respondents to pay the aforesaid amounts within a time frame as may be fixed by this court. ORDER

This Writ Petition has been filed for the following reliefs: "To issue a Writ of Certiorarified Mandamus calling for the records from the 2nd respondent relating to the issue of Online Tender Notice issued in Tender No.ME -29-II -1075- 2025 Run Date/time. 20.11.2025 /17.00 hrs and from the 1st respondent relating to his Lr.No.M/GS/202526/ABS/GDY/Electrical Works dated 21.11.2025 and quash the same and further to direct the respondents (i) to measure the works completed fully under the non- scheduled items of Electrical works under item Nos. 1,2,3,4,7,8 and 13 and pay for the same with 18 percent from Feb 2025 to the date of payment.

(ii) to direct the respondents to show the location at which the purchased materials to be fixed at site and to pay for the same with 18 percent interest to the petitioner from Feb 2025 to till the date of payment. (iii) to pay to the petitioner the balance amount for the completed works under the main contract which has not been paid without any reason from Feb 2025 to the date of payment and (iv) to direct the respondents to pay the aforesaid amounts within a time frame as may be fixed by this Court."

2. Heard Mr.N.Subramaniyan, learned counsel for the petitioner and Mr.A.R.L.Sundaresan, learned Additional Solicitor General of India appearing for Ms.P.J.Anitha, learned counsel for respondents.

After extensively hearing the arguments on both sides, it has now been suggested by the learned counsel for the petitioner that, with respect to item Nos. 1,2,3,4,7,8 and 13 which have been partly completed, he would complete the remaining work within a period of three weeks from the date on which the respondents provide him with the locations / places of installation in terms of the petitioner's letter dated 09.12.2024, particularly with reference to the rates. The learned Additional Solicitor General has accepted the said suggestion on instructions.

4. With reference to the remaining items of work, the learned counsel for the petitioner would submit that he has no objection to the same being put up for a fresh tender. Further, he would submit that the petitioner will not make any claim for being allocated the new items. 4/6

5. Recording the above submissions, this writ petition is disposed of . No costs. Consequently, connected miscellaneous petitions are closed.
