Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order passed by the 1st respondent in Na.Ka.No. 097/ Mines/ 2025 dated 4.11.2025 quash the same and direct the respondents to permit the petitioner tor un the standalone Msand manufacturing unit of the petitioner in the name of STAR VSI Manufacturing Sand Unit at S.No. 382/ 5 , Punjaithuraipalayam Village, Gobichettipalayam Taluk, Erode District.

ORDER

By consent of both parties, this writ petition is taken up for final in the admission stage itself.

2. Challenge has been made to the order passed by the District Collector, Erode in closure of manufacturing Sand Unit owned by the petitioner.

3. Heard both sides and perused the materials placed on record.

At the outset, it is relevant to note that as against the order passed by the District Collector, under 36-C of the Tamil Nadu Minor Mineral Concession Rules, 1959, appeal remedy is available before the Director of Geology and Mining within a period of 30 days from the date of receipt of the order of the District Collector. Such view of the matter, when an alternative remedy is available to the petitioner, this writ petition is not maintainable. Hence, the petitioner is permitted to file an appeal before the Director of Geology and Mining within a period of 30 days from today. If such an appeal is filed, the appeal be disposed of without any further delay not later than four 2 / 4

months thereafter.

5. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions stand closed. Registry is directed to return the original impugned order to the counsel for the petitioner filed along with this writ petition, forthwith.
