Respondents Prayer: Petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus, directing the respondents to consider the petitioner's representation dated 01.11.2025 and issuing vending certificate thereby permitting the bunk shop at street corner of Vaigai Colony, 12th Avenue, Ashok Nagar, Chennai - 600 083, which is directly opposite Ram Kumar Medicals, within a time limit to be stipulated by this Court.

ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) Prayer sought in the present writ petition is for a writ of mandamus, directing the respondents to consider the petitioner's representation dated 01.11.2025 and to issue vending certificate, thereby, permitting the bunk-shop at the street corner of Vaigai Colony, 12th Avenue, Ashok Nagar, Chennai - 600 083.

2. Heard Mr.R.Saravanapandiyan, learned counsel for the petitioner, Mr.M.Murali, learned Government Advocate for the first respondent and Mr.A.Arunbabu, learned Standing Counsel for the second respondent.

3. The learned Standing Counsel appearing for the second respondent Corporation would submit that, the place identified by the petitioner, for which he has sought vending certificate, since has been identified to be a non-vending zone and a declaration to that effect would be issued shortly, the said representation cannot be considered for grant of such permission in the said address, but, at the same time, if the petitioner makes a fresh application in any other vending zone, that would be considered.

4. Recording the said submissions made by the learned Standing Counsel appearing for the second respondent, this writ petition is disposed of with an observation that, since the prayer sought in the present writ petition cannot be granted, as it is in non-vending zone, it is open to the petitioner to make a fresh application after identifying any vending zone area and in that case, such application would be considered and decided by the second respondent.

5. The writ petition is disposed of accordingly. There shall be no order as to costs.
