Respondent(s) PRAYER This writ petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents 1 to 6 to provide an alternative route to transport the mineral resources from the quarry by the 7th respondent in Onam Pakkam Panchayat, immediately to stop constructing a road on Government Land approximately of 4 acres through our village, again restore that land into a lake water inflow area and an area rich in natural resources and also considering the representation Letter dated 22.07.2024 16.09.2024 , 19.09.2024 and 25.08.2025, within a time limit that may be stipulated by this Honourable Court For Petitioner(s):

ORDER

This writ petition has been filed seeking a direction to the respondents 1 to 6 to consider the petitioner's representation and to provide an alternative route for transporting mineral resources from the quarry of the seventh respondent.

2. According to the petitioner, he belongs to Nagamalai Village. The seventh respondent has purchased land about 100 acres and is proposing to establish a quarry. For the purpose of transporting mineral resources from the said quarry, Government land has been utilized for laying the road. At present, more than 100 lorries are transporting mineral resources from the said quarry by using the said road as a regular route through the village, thereby seriously affecting the day to day life of the villagers. Hence, the petitioner submitted representations on 22.07.2024, 16.09.2024, 19.09.2024 and 25.08.2025 seeking an alternative road to the quarry of the seventh respondent. But, no action has been taken till date. Hence, the present writ petition has been filed.

3. Heard the learned counsel on either side and perused the materials placed before this Court carefully.

4. The relief sought by the petitioner is in the nature of a public interest litigation. According to the petitioner, the movement of more than 100 lorries through the village would cause serious damage and inconvenience to the villagers. Since the grievance raised is essentially a public cause, the petition seeking a direction to consider the petitioner's representation is not maintainable in the present form. The proper course open to the petitioner is to approach this Court by filing an appropriate public interest litigation.
