The petitioner, who was arrested and remanded to judicial custody on 25.10.2025 for the offences punishable under Section 8(c) r/w 23, 28 and 29 of the NDPS Act and under Sections 20(b)(ii)(B) of the NDPS Act, 1985 in R.R.No. 42 of 2025 registered on the file of Principal Special Court under EC & NDPS Act, Chennai.

2. The case of the prosecution is that the petitioner had illegally concealed and transported 1.480 kilo grams of Ganja from Bangkok to Chennai and the same was seized by the respondent police. Hence, the respondent police arrested the petitioner on 25.10.2025.

3. The learned counsel for the petitioner submits that the contraband was seized only 1.480 kgs and it is an intermediate quantity and the petitioner has not any bad antecedent and he is in judicial custody from 25.10.2025. He further submits that the petitioner is ready to abide any condition imposed by this Court. Hence, he prayed for grant of bail to the 2/6

petitioner.

Mr.K.Purushothaman, learned Special Public Prosecutor [For Customs] appearing for the respondent police reiterated the prosecution case and submitted that the petitioner had transported Ganja from Bangkok to Chennai and the petitioner is a part of the net work, operating from Bangkok to Chennai regularly, Ganja is smuggled and the persons sent the contraband are yet to be identified and investigation in this case is pending and he opposed for grant of bail to the petitioner.

5.I have also gone through the FIR and other connected materials it reveals that it is a case of intermediate quantity. The petitioner was arrested and remanded to judicial custody from 25.10.2025 and he has not any previous case and under Section 37 of the NDPS Act, is not applicable to the present case. Hence, I am inclined to grant bail to the petitioner with certain conditions:- 3/6

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned the Customs Court, Alandur and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] that the petitioner shall report before the Customs Court, Alandur, daily at 10.30 am for a period of four weeks and appear all the hearing dates.

[c] On breach of any of the aforementioned 4/6

conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
