..Respondent Prayer : Criminal Original Petition is filed under Section 528 of BNSS Act, 2023 praying to modify the condition No.(i) imposed on the petitioner by the learned Principal Sessions Judge, Namakkal in Crl.M.P.No. 1026 of 2025 vide order dated 18.11.2025 that the petitioner/accused shall deposit a sum of Rs.1,00,000/- as refundable deposit towards damages, to the credit of the Crime No. 143 of 2025 of Velagoundampatty Police Station before the learned Judicial Magistrate No.I, Namakkal.

ORDER

This Criminal Original Petition is filed seeking modification of the order passed by the learned Principal Sessions Judge, Namakkal, in Crl.M.P.No.1026 of 2025 vide order dated 18.11.2025, wherein, the trial Court directed the petitioner to deposit a sum of Rs.1,00,000/- as refundable deposit towards damages into the credit of Crime No.143 of 2025. 1/3

2.The learned Counsel for the petitioner submitted that the total damages caused in this case are exaggerated and the petitioner is not in a position to pay the huge amount of Rs.1,00,000/-. However, the petitioner is now ready to deposit a sum of Rs.75,000/- (Rupees Seventy Five Thousand Only) and an affidavit to that effect has also been filed. Hence, he seeks to modify the condition imposed by the Trial Court.

3.Considering the submissions and the fact that the affidavit of the petitioner has also been filed, this Court is inclined to modify the Condition No. (i) of the order in Crl.M.P.No. 1026 of 2025, dated 18.11.2025, which reads as follows:

(i) that the petitioner shall deposit a sum of Rs.75,000/- [Rupees Seventy Five Thousand Only] to the credit of Crime No.143 of 2025 on the file of Velagoundamapatty Police Station, within a period of three weeks from the date of receipt of a copy of this order.

4.The rest of the conditions shall remains unaltered. 5.Accordingly, this Criminal Original Petition is ordered. 02.02.2026 MSM 2/3
