This petition has been filed to cancel the anticipatory bail granted to the second respondent herein in Crl.O.P.No.30565 of 2024 dated 09.12.2024. 1/4

2. The learned counsel appearing for the petitioner herein submitted that the second respondent has not complied with the anticipatory bail conditions imposed on him by this Court, vide order dated 09.12.2024 in Crl.O.P.No.30565 of 2024, hence prays to cancel the anticipatory bail granted to the second respondent herein.

3. The learned counsel appearing for the second respondent herein submitted that, though the second respondent had executed sureties as per the anticipatory bail order of this Court, he was unable to appear before the respondent police as per the condition in para No.4(b) imposed on him by this Court in Crl.O.P.No.30565 of 2024 dated 09.12.2024 due to his ill health. He also submitted that the second respondent herein is now ready to comply with the aforesaid condition, hence prays not to cancel the anticipatory bail granted to the second respondent herein.

4. Heard the learned Government Advocate (Crl. Side) appearing for the first respondent.

5. I have considered the submissions made and also perused the materials available on record, including the FIR of the present case, which shows that the allegations levelled against the second respondent herein is under Sections 2/4

294(b), 323 and 506(i) of IPC. Though, the learned counsel appearing for the petitioner herein submitted that there is a violation of anticipatory bail conditions imposed by this Court, considering the fact that the second respondent herein had executed sureties as per the order of this Court and the nature of offence of this case, this Court is inclined to grant one more opportunity to the second respondent herein and direct him to comply with the condition in para No.4(b) imposed on him by this Court in Crl.O.P.No.30565 of 2024 dated 09.12.2024, from 09.01.2026 onwards without fail.
