ORDER

The petitioner challenges order of the second respondent intimating the petitioner that Electricity connection in Consumer No.053010-833 will be transferred to the name of the seventh respondent viz., R.Eswarmoorthy.

2. It is the contention of the petitioners that they are the owner of the property in R.S.Nos.506/3 and 506/5 in Karumandichellipalayam Village, Perundurai Taluk, Erode District. As the petitioners suffered heavy loss in the textile business, they availed a loan from one S.N.Periyasamy and while availing loan, the petitioners were asked to sign in many blank papers and later, respondents 3 to 5 colluded together and created a sale document and only in the year 2010, the petitioners came to know that the sale deed was created fraudulently. Hence, the 2 / 5

petitioners have filed a suit in O.S.No.151 of 2010 before the Subordinate Court, Perundurai and the same was dismissed on 04.11.2025 and the petitioners filed an appeal as against the dismissal of suit in A.S.No.132 of 2025 and the same is now pending on the file of II Additional District Judge, Erode.

The learned counsel for the petitioners submits that petitioners are in possession of the property till date and the Aadhar Card, Ration Card, Gas Connection and Electricity connection are exist in the name of the petitioners and therefore, transferring the electricity connection will cause serious prejudice to the petitioners as they do not have any other house.

4. Heard Mr.N.Planikumar, learned counsel for the petitioners, Mr.S.Rajesh, learned Government Advocate for first respondent and Mr.I.Syed Sibghatulla, learned Standing counsel for the second respondent.

5. As the appeal filed against the dismissal of the suit is pending and the petitioners are in possession of the property till date, 3 / 5

there shall not be disconnection of electricity as long as they pay the electricity charges.

6. With the above direction, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs.
