Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to correct the error in revenue record relating to extent mentioned in patta No. 307 in respect of petitioner's property in SF No.161/13 Pillanallur Village, Rasipuram Taluk, Namakkal district as per the proceeding of the 1st respondent in Na.Ka.No.2481/2024 - A(1) dated 25.09.2024 by considering the petitioners representation dated 12.09.2023. For Petitioner : Mr.R.Marudhachalamurthy For Respondents : Mr.S.Arumugam Government Advocate Order This Writ Petition is filed by the petitioner seeking for issuance of a mandamus to the second respondent to correct the error alleged to occurred in the revenue records pertaining to the property (morefully described in the prayer to this Writ Petition) based on the petitioner's representation dated 12.09.2023, within a time frame to be fixed by this Court.
2. The petitioner's grievance is that Patta No.307 was issued in favour of the petitioner for the property (morefully described in the prayer to this Writ Petition) but the extent of the property has been wrongly mentioned 2/5
in the revenue records and the same has to be rectified. The petitioner made a representation for the said purpose to the respondents on 12.09.2023. Since the said representation has not been considered, the petitioner has filed the present Writ Petition.
3. Mr.S.Arumugam, learned Government Advocate accepts notice for respondents.
4. No prejudice would be caused to the respondents if the petitioner's representation is considered on merits and in accordance with law within a time frame to be fixed by this Court. In fact, the petitioner also filed a proceedings of the respective respondents recommending the request of the petitioner for rectification of the patta. This Court is not expressing any opinion on the merits of the representation made by the petitioner.
5. For the foregoing reasons, this Court directs the respondent No.2 to pass final orders on merits and in accordance with law on the petitioner's representation dated 12.09.2023, which has been given for the purpose of correction of the error crept in the revenue records relating to the extent of 3/5
the property (morefully described in the prayer to this Writ Petition) bearing patta No.307 within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the aforesaid direction, this Writ Petition is disposed of. No costs.
