ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The learned counsel for the petitioner submits that as, after the passing of the impugned order, Bench of the Debt Recovery Tribunal (for short, 'the Tribunal') was not available, petitioner, in view of urgency, had to rush to this Court by filing this petition.

2. Learned counsel for the respondent would submit that there is no vacancy as such and merely because on a particular day or days the Tribunal was not functioning, petition may not be entertained.

3. Admittedly, there is no vacancy and the Tribunal is manned by Presiding Officer. Therefore, we are not inclined to grant any relief to the petitioner in this petition.
