ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.08.2025 for the offences punishable under Sections 5(l), 5(j)(ii), 5(n) r/w Section 6 of Protection of Children from Sexual Offence Act, 2012 r/w 351(2) of BNS in Crime No.257 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 27.10.2025 in Crl.O.P.No. 29099 of 2025 for the following reasons:

"5. Considering the gravity of the offence alleged against the petitioner, who is a relative of the victim girl, and though it is stated that the investigation has been completed, the final report has not yet been filed before the competent Court. Hence, this Court is not inclined to grant bail to the petitioner at this stage. However, the petitioner is at liberty to file a fresh bail application after the case is taken on file by the Special Court. "

The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 29.08.2025; that the final report has been filed by the respondent; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner submitted that the final report has been filed but not yet taken on file. 4.

Considering the submissions made, facts and circumstances of the case, the nature of offence, the fact that there is no change in circumstances, after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.29099 of 2025, this Court is not inclined to grant bail to the petitioner.
