ORDER

The petitioner asserts that settlement deed dated 09.09.2014 bearing Document No.10248 of 2014 was executed on the basis of the invalid legal heirship certificate dated 12.09.2007. In support of such contention, order dated 06.11.2025 of this Court in W.P. No.39641 of 2025 is relied upon.

2. Learned counsel for the petitioner submits that the respondents may be directed to consider the petitioner's representation seeking cancellation of settlement deed dated 09.09.2014.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for both the respondents. He submits that the petitioner should approach the jurisdictional civil Court and that the registering authorities do not have the power of cancellation.

4. On perusal of the order dated 06.11.2025 in W.P. No.39641 of 2025, it appears that this Court recorded a finding that the legal heirship certificate dated 12.09.2007 is not genuine. Therefore, it is open to the petitioner to rely on the said order in civil proceedings 2/4

before the jurisdictional Civil Court so as to seek cancellation of settlement deed dated 09.09.2014 bearing Document No.10248 of 2014.

5. With the above observations, this writ petition is disposed of. There shall be no order as to costs.
