ORDER

The petitioner is the plaintiff who succeeded on title and subsequently initiated execution proceedings, which also ended in favour of the petitioner. However, the defendants later took out an application to condone the delay and set aside the ex-parte decree. The said condone delay application were filed in IA No.2 of 2023.

2. The grievance of the petitioner is that despite having filed a counter affidavit, even immediately without any delay, the application is still kept

pending without being disposed, which is causing serious prejudice to the petitioner.

3. In the light of the limited relief sought for in the present revision, I am inclined to dispense with notice to the respondents. The learned Subordinate Court, Tambaram shall conduct due inquiry and dispose of I.A.No.2 of 2023 in O.S.No.308 of 2015.

4. It is submitted that the counter has been filed and even arguments advanced on either sides and what remains is only passing of orders. Accordingly, the Civil Revision Petition is allowed and the learned Sub Court, Tambaram is directed to pass final order in I.A.No.2 of 2023 in O.S.No.308 of 2015 by 16.03.2026. No costs.
