PRAYER: Criminal Original Petition is filed under Section 483 of BNSS, 2023, praying to grant bail to the petitioner in connection with Crime No.12 of 2025 on the file of respondent police.

O R D E R

The petitioner who was arrested and remanded to judicial custody on 07.10.2025 for the offences punishable under Section 5(i), 5(j)(ii), and 6 of the POCSO Act, 2012 in Crime No.12 of 2025, registered on the file respondent police, seeks bail.

2. The allegation against the petitioner is that he developed the contact with the victim girl who is aged about 17 years under the pretext of loving her, convinced her and committed aggravated penetrative sexual assault and further threatened her with dire consequences. If the same would be informed to her family members, he threatened her, to murder her mother. Unable to avoid the same, she went to his home resulted in she got pregnant. Hence the complaint was lodged and the petitioner was arrested on 07.10.2025.

3.The learned counsel for the petitioner submits that the petitioner was arrested and remanded to judicial custody from 09.10.2025 and the respondent police has not properly communicated grounds of arrest. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that the statement of the victim girl is recorded under Section 183 of BNS Act, 2023 Hence, he opposed for grant of bail to the petitioner.

5.I have also gone through the FIR and other connected records placed before me, it is stated that the petitioner committed aggravated penetrative sexual assault by threatening her that he will murder her and also murder her family members, unable to bear the harassment, she had come complied his demand. It resulted in pregnancy. Thereafter, it was reported to the family members and case was registered.

In view of the above facts and circumstances of the case and the gravity of offence committed by the petitioner herein; this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
