ORDER
Challenging the impugned order passed in IA No.14 of 2024 in LAOP No.3 of 2007 dated 07.10.2025 on the file of the I Additional Subordinate Court, Coimbatore, the claimant No.55 has preferred the present revision petition.

The revision petitioner / claimant No.55 has filed an application before the trial court under Section 151 of CPC in order to split up the IA No.14 of 2024 in LAOP No.3 of 2007 separately in respect of the land for the extent of 2 acres in S.F. No.600/2A2 and 33 cents in S.F. No.601/1A1B. Aggrieved over the same, the claimant No.55 has preferred the present revision petition.

The learned counsel for the revision petitioner submits that as on date the claimant No.55 is aged about 72 years and based on the sale deed executed by the court in OS No.22 of 1985, he became the absolute owner of 35 cents with specific four boundaries which is under the acquisition proceedings in LAOP No.3 of 2007 and as on date he is entitled to get the award amount based on the said sale deed which was confirmed upto Hon'ble Apex Court proceedings. Till date the sale deed was not set aside. Since he is aged about 72 years he wants to split up the proceedings and dispose of the case. Since there are many number of claimants and considering his age he prays to split up the proceedings. But the trial court failed to appreciate the same properly.
4. The learned Government Advocate for the respondent submits that there are 55 claimants covering an extent of 27 acres. Admittedly, the acquisition proceedings were initiated in the year 2007. Therefore for each one of the claimants, the proceedings cannot be split up. Therefore, he raised
objections.
5. Considering the submissions, the fact reveals that as on date the revision petitioner is aged about 72 years and facing the proceedings from the year 2007. As per the sale deed dated 27.12.2011, he is the absolute owner of 2 acres, in which 35 cents are under acquisition. Now he is facing land acquisition proceedings in LAOP No.3 of 2007. Therefore, in respect of 35 cents, he is the absolute owner and considering his age, the trial court is directed to split up the proceedings and pass appropriate orders in the manner known to law.

Accordingly, this Civil Revision Petition is Allowed and the impugned order passed in IA No.14 of 2024 in LAOP No.3 of 2007 dated 07.10.2025 on the file of the I Additional Subordinate Court, Coimbatore, is set aside. The trial judge is directed to dispose of the case within a period of two months from the date of receipt of a copy of this order. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
