Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents to consider the representation dated 16.07.202 and to cancel all the fraudulently registered documents with regard to the plot nos. 1809, 466 and 2375 in Ganapathi Phase-1, LIG-1 in Tamil Nadu Housing Board, Coimbatore Division, Coimbatore and to register those plots in favour of the petitioner, within a stipulated period.

O R D E R

This writ petition has been filed for the following relief:- "directing the respondents to consider the representation dated 16.07.202 and to cancel all the fraudulently registered documents with regard to the plot nos. 1809, 466 and 2375 in Ganapathi Phase-1, LIG-1 in Tamil Nadu Housing Board, Coimbatore Division, Coimbatore and to register those plots in favour of the petitioner, within a stipulated period." 2/5

2. The petitioner's case is that she along with her husband is the owner of the Plot Nos.1809, 466 and 2375 in Ganapathi Phase-1, LIG-1 in Tamil Nadu Housing Board, Coimbatore Division, Coimbatore. She had paid the entire installment amount for the above said plots.

3. While so, between the year 2009 and 2011, the subject plots were fraudulently registered in favour of third parties by Tamil Nadu Housing Board officer. On coming to know about the same, the petitioner had lodged an FIR in Crime No.8/2014 under Sections 120(b), 468, 471, 420 of the IPC against ten individuals, including the TNHB officers and the beneficiaries, which is pending in C.C.No. 2435/2023.

4. On 16.07.2025, the petitioner had submitted a representation to the respondents seeking cancellation of the fraudulently registered documents and registration of the plots in her favour. However, the said representation has not been disposed of to date. Hence, the petitioner is before this Court.

5. Heard the learned counsel on either side and perused the records. 3/5

6. Considering the limited request of the petitioner and taking note of the fact the petitioner's representation dated 16.07.2025 has not been considered to date, the Writ Petition is allowed. The 2 respondent is directed to consider the petitioner's representation dated 16.07.2025 and dispose of the same on merits and in accordance with law, after affording an opportunity of hearing to all the interested parties, within a period of 3 months from the date of receipt of a copy of this order.
