ORDER

Since the dispute raised by the petitioner is against his brother in this writ petition, the representation given by the petitioner dated 06.10.2025 seeking for cancellation of Natham Patta for the property, morefully described in the prayer to this writ petition can be agitated only before the Civil Court, as there are disputed questions of fact involved.

2.Since this Court has expressed the said view to the learned counsel for the petitioner, the learned counsel for the petitioner sought liberty for the petitioner to file a civil suit as against the respondents. 3.No prejudice would be caused to the respondents if such a liberty is granted by this Court.

4.For the foregoing reasons, since this writ petition is not maintainable, in view of the disputed questions of fact involved, this writ petition is disposed of

by granting liberty to the petitioner to file a civil suit against the respondents for the relief as prayed for in this writ petition as well as for any other relief, the petitioner deems fit to seek. No costs.
