ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.11.2025, for the offences punishable under Sections 333, 296(b), 109(1),351(3), of BNS 2023 in Crime No.420 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner was having extra marital affair with the defacto complainant. It is alleged that the defacto complainant refused to continue the same, due to which the petitioner abused the defacto complainant and also attacked the husband of the defacto complainant with knife. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case. He further submitted that even though the injured discharged from the hospital he is taking treatment in the private hospital and the petitioner is having 5 previous case similar in nature 5.Considering the facts of the case and the bad antecedent of the petitioner and the injured is still taking treatment in the private hospital, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this criminal original petition stands dismissed.
