ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.08.2025 based on the execution of NBW dated 23.07.2025 in S.C.No.336 of 2023 on the file of the learned XVIII Additional District and Sessions Court at Chennai for the offence under Section 302 r/w 34 and 201 of IPC registered in Crime No.759 of 2021 on the file of the respondent, seeks bail.

2. This Court has dismissed the earlier bail application of the petitioner in Crl.O.P.No.30129 of 2025 on 05.11.2025 for the following reasons:

4.Considering the facts of the case, the previous and subsequent antecedents of the petitioner, who had involved in two other murder cases, taking note of the fact that the trial has commenced and if the petitioner is enlarged on bail, there is a possibility of hampering of trial process, hence this Court is not inclined to grant bail to the petitioner at this stage.

3.The learned counsel appearing for the petitioner submitted that earlier the petitioner has granted bail and he was unable to appear before the Trial Court, NBW was issued. He further submitted that the co-accused was granted bail and he is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 2/5

4.The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the case is posed for examination of L.W.9 on 21.01.2026. He further submitted that there are two previous cases pending agaisnt the petitioner and this is the second bail application and the earlier bail application in Crl.O.P.No.30129 of 2025 was dismissed by this Court on 05.11.2025.

In view of the above facts and this is the second bail application and the earlier bail application in Crl.O.P.No.30129 of 2025 was dismissed by this Court on 05.11.2025 and also considering the bad antecedents of the petitioner and the fact that the trial has commenced, there is a possibility of hampering of trial process, this Court is not inclined to grant bail to the petitioner. This Criminal Original Petition stands dismissed . 02.01.2026 smn 3/5
