Rc.No.677/DCP/KOL/Camp/2025 dated 16.09.2025 in 2nd respondent Crime No.326 of 2025 issued to the Immigration Officer, Chennai Airport against the petitioner and permit the petitioner to go abroad. For Petitioner : Mr.M.Vigneshwaran For Respondents : Mr.S.Santhosh Government Advocate (Crl.Side) C O M M O N O R D E R These writ petitions are filed to withdraw the Look Out Circulars issued against the petitioner and permit him to go abroad. 2.The learned counsel for the petitioner would submit that the petitioner is an accused in Crime No.10 of 2025 registered by the second respondent for the offences under Sections 498(A) and 506(I) of IPC and also in Crime No.

326 of 2025 registered by the second respondent for the offences under Sections 296(b), 115(2), 351(2) of BNSS, 2023 and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002. He would submit that the respondents, after completing the investigation in both the cases, have filed the final report for crime in Cr.No.10 of 2025 on the file of the Mahila Court, Egmore and final report for crime in Cr.No.326 of 2025 on the file of the V Metropolitan Magistrate Court, Egmore. However, the final reports have not been taken on file.

3.The learned counsel for the petitioner would further submit that the petitioner was employed in Dublin and because of these cases, the petitioner had come here and the respondents, to ensure the presence of the petitioner for the purpose of investigation and to ensure that the petitioner does not leave the country has issued Look Out Circulars. He would further submit that the petitioner had co-operated for the investigation and now, investigation is over. The petitioner was employed as Principal Data Scientist in Dublin, Ireland, and that the employer has sent an e-mail communication stating that if he does not return back to Ireland, he will be losing his employment. He would further submit that the petitioner undertakes to abide by any stringent condition, including availablility before the respective trial Courts for the trial in the cases and he is also ready to furnish sureties and give an undertaking stating that he will co-operate for the disposal of the trial.

4.The learned Government Advocate (Crl.Side) would submit that the petitioner is an accused in Cr.No.10 of 2025 registered for the offences under Sections 498-A and 506 of IPC. Since the petitioner was employed abroad, based on the request of the second respondent, the first respondent has requested for issuance of Look Out Circular. However, he would submit that the investigation has been completed and final report has been filed 3/6

before the Mahila Court, Egmore, and it is yet to be taken on file. He would further submit that if the petitioner leaves the country, he will not be available for facing the trial. He would also submit that the petitioner is an accused in Cr.No.326 of 2025 registered by the Peravallur Police Station, Kolathur District, and the investigation has been completed and the final report has been filed before the V Metropolitan Magistrate Court, Egmore. Therefore, he would submit that in both the cases, the investigation has been completed and the final report has been filed before the respective Courts. 5.Heard the learned counsel on either side and perused the materials available on record.

6.Admittedly, the matter arises out of matrimonial dispute. In the opinion of this Court, the petitioner cannot be prevented from travelling abroad for his employment purpose. Of course, permitting the petitioner to travel abroad should be subject to certain restrictions. 7.In view of the above, the petitioner is directed to appear before the Mahila Court, Egmore in Cr.No.10 of 2025 and before the V Metropolitan Magistrate Court, Egmore, in Cr.No.326 of 2025 and execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand 4/6

only) with two sureties each and he shall also file an affidavit undertaking to appear before the respective trial Courts on the dates fixed for trial of the cases and also give his address in Ireland and also his e-mail address and he shall be available for the purpose of progress of trials. It is made clear that in the event of the petitioner not appearing for trial, the respondent police are at liberty to revive the Look Out Circulars. On such execution of bond by the petitioner, the Deputy Commissioner of Police, Kolathur District, Greater Chennai Police, Peravallur, Chennai, is directed to intimate the Immigration Officer of the Chennai International Airport Authority of India at Bureau of Immigration, Ground Floor (Annexe),Shastri Bhavan, No.26, Haddows Road, Nungambakkam, Chennai 600 006, for withdrawal of the Look Out Circulars (LOC).

With the above directions, the writ petitions criminal stand disposed of. No costs.
