Respondent(s) PRAYER The Criminal Miscellaneous Petition is filed under Section 528 of BNSS, to modify the condition put forth by this Honble Court that the petitioner shall deposit a sum of Rs.40,000/- after deducing the amount which was already deposited by the appellant / accused, if any, to the credit of Cr.No.133 of 2025 in the order dated 12.11.2025 in Crl.A.No.1702 of 2025 and pass such further orders.

ORDER

This petition has been filed seeking modification of the condition, 'that the appellant/accused shall deposit a sum of Rs.40,000/-, after deducting the amount which was already deposited by the appellant/accused, if any, to the credit of Crime No.133 of 2025, within period of four weeks from the date of receipt of a copy of the order', imposed by this Court in Crl.A.No.1702 of 2025 dated 12.11.2025.

2. Heard the learned counsel for the petitioner and perused the materials available on records.

3. Considering the submission made by the learned counsel for the petitioner, the condition in paragraph No. 9(b) imposed on the appellant in Crl.A.No.1702 of 2025 dated 12.11.2025 is modified to the effect that the petitioner shall deposit a sum of Rs.25,000/- to the credit of Crime No.133 of 2025, within a period of four weeks from the date of receipt of a copy of this order.
