ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2), 326(a) of BNS Act, 2023 and Sec 21(1) of Mines and Minerals (Development and Regulation) Act in Crime No.339 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that while the respondent 1/4

police was on regular patrol was found that the petitioner was illegally transported 8 units of river sand from Bahuda river, Chithoor to Andhra Pradesh in a lorry without any valid licence. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and upon instructions reported that the investigation in this case is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); the nature of allegations, investigation of this case is still pending, and also the fact that the petitioner has illegally transported huge quantity of river sand which causing severe damage to the ecology and water body, this Court is not 2/4

inclined to grant anticipatory bail to the petitioner.
