O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 318(4) of BNS, 2023 in Crime No.116 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner joining hands with her husband involved in leasing out the various house on rental basis and thereby collected a sum of Rs.77 lakhs from various victims, however they have not remitted the same to the accounts of the house owner. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is the land owner and the entire firm activities was taken care by the husband of the petitioner herein and she was not aware of the alleged transactions. Hence, prayed for grant of anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl. Side) submitted that total amount involved is Rs.77 lakhs and all the correspondence were

made only by this petitioner and further the money was also deposited by all the tenants into the account maintained by her and further no amount was recovered.

5. Considering the magnitude of the amount involved in this case and this petitioner is alleged to have been played major role and the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
