PRAYER: Criminal Original Petition filed under Section 483 of BNSS, 2023, to enlarge the petitioners on bail in Crime No.437 of 2025 on the file of the respondent police.

ORDER

The petitioners, who were arrested and remanded to judicial custody on 28.09.2025 for the offences punishable under Sections 69, 318(2), 318(4), 351(3) of BNS 2023 and Section 303(2) of BNS Act,2023, in Crime No.437 of 2025, registered on the file of the respondent police, seeks bail.

2. This court had earlier dismissed the bail application of the petitioners in CRL.OP.No.31337 of 2025 vide order dated 17.11.2025 on the following grounds:

"5. Considering the facts and circumstances of the case and taking note of the submissions made by the learned Government Advocate (Crl.Side) though the properties have been recovered, since petitioners 1 to 4 having ten previous bad antecedents of a similar in nature, this Court is not inclined to grant bail to them. Accordingly, insofar as petitioners 1 to 4 are concerned, this Criminal Original Petition stands dismissed."

3. The learned counsel appearing for the petitioners submitted that out of ten previous cases reported against these petitioners, they were already acquitted in three cases and there are in incarceration nearly 100 days and hence, he prays for grant of bail of petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case. Hence, he opposed for grant of bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Though it is stated that petitioners were acquitted in three cases, seven cases are pending against them and this is a case of theft and they are habitual offenders and if they are released on bail, there is a likelihood to indulge in similar offence, and hence this court is not inclined to grant bail to the petitioners.
