ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.11.2025 for the offences punishable under Sections 24(1) of COTPA Act, 2003 and Sections 123, 275 of BNS in Crime No.447 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 25.11.2025 in Crl.O.P.No.32196 of 2025 for the following reasons: "5. Considering the facts and circumstances of the case, that the petitioner is arrested only on 12.11.2025 with the possession of 80 kilograms of banned tobacco products and the petitioner is having bad antecedents and also having any one previous case similar in nature, if the petitioner granted bail, he will indulge in similar offences, this Court is not inclined to grant bail to the petitioner with certain conditions." 2.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent. 3.

Considering the submissions made, facts and circumstances of the case, the nature of offence, the fact that there is no change in circumstances, after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.32196 of 2025, this Court is not inclined to grant bail to the 2/4

petitioner.
