Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned settlement deed dated 06.02.2006 registered as Document No.957/2006 on the file of the second respondents, the impugned General Power of Attorney dated 12.03.2008 registered as Document No.1015/2008 on the file of the second respondents, and the impugned sale deed dated 13.04.2022 registered as Document No.5714/2022 on the file of the third respondents, and quash the same as illegal, void, fraudulent and obtained by impersonation, forgery and violation of the Registration Act, 1908 and the Tamil Nadu Registration Rules and Circulars and consequently direct respondents 1 to 3 to cancel the aforesaid documents in the relevant registers maintained under the Registration Act and to make necessary entries in the Encumbrance Register. ORDER

The petitioner seeks cancellation of settlement deed dated 06.02.2006, general power of attorney dated 12.03.2008 and sale deed dated 13.04.2022.

2. The petitioner asserts that her husband, Mr.Manavalan, executed settlement deed dated 06.02.2006 upon inducement by one Mr.S.V.Kumar. It is also asserted that the said individual induced the petitioner to execute power of attorney dated 12.03.2008. In those circumstances, after lodging complaints and issuing notices to the official respondents, the present writ petition has been filed.

3. Learned Special Government Pleader accepts notice for respondents 1 to 3.

4. The petitioner has approached this Court in 2025 alleging that a settlement deed and power of attorney executed in 2006 and 2008, respectively, were obtained by impersonation, forgery and in violation of 3/5

applicable statutes. The affidavit does not contain any acceptable explanation for the inordinate delay in filing the writ petition. Even otherwise, the issues raised in this writ petition require adjudication of disputed questions of fact. For both these reasons, this writ petition cannot be sustained and this writ petition is hereby dismissed without any order as to costs.
