ORDER

The present Criminal Original Petition has been filed seeking to modify the condition imposed by the learned Judicial Magistrate-III, Vellore, Vellore District, on 27.11.2025 in Crl.M.P.No.15122 of 2024.

2. The grievance of the petitioner is that he is the owner of the vehicle bearing registration No.TN 09 BE 3492, which was seized by the respondent police in connection with a case in Crime No.206 of 2025 registered for the offences under Sections 126(2), 296(b), 351(3), 115(2) and 304(2) of BNS, 2023. The petitioner is not an accused. The petitioner filed a petition in Crl.M.P.No.15122 of 2024 for return of vehicle. The learned Judicial Magistrate No.III, Vellore, while allowing the petition on 27.11.2025, directed the petitioner to execute a personal bond for Rs.15,00,000/- with two sureties for a like sum. He submitted that since the condition imposed on the petitioner is onerous, he is unable to take back his vehicle and has prayed to modify the said condition.

3. Heard both sides and perused the materials available on record.

4. Considering the facts and circumstances of the case and taking note of the fact that the petitioner, who is not an accused in this case, is the original owner of the vehicle, this Court is inclined to modify the aforesaid condition.

5. Accordingly, the condition No.1 imposed by the learned Judicial Magistrate No.III, Vellore, in Crl.M.P.No.15122 of 2024 on 27.11.2025, is modified to the effect that the petitioner shall execute a personal bond for a sum of Rs.5,00,000/- (Rupees Five Lakhs only) with two sureties each for a like

sum to the satisfaction of the Court and all other conditions shall remain unaltered.

6. In view of the above, this Criminal Original Petition stands disposed of.
